Pursuant to Assembly Bill 361, this meeting may be conducted by teleconference. There will be in-person public access to the meeting location.

Transmittal prior to the start of the meeting will help ensure that your correspondence is fully considered. Any correspondence received during or after the meeting will be distributed to the City Council and retained for the official record.

PUBLIC TESTIMONY (Council Chamber): This time has been set aside for members of the public to address the City Council on the agenda item. Two (2) minutes will be assigned to each speaker.

QUALIFICATION OF INITIATIVE MEASURE PROPOSING TO AMEND THE DOWNTOWN PALM SPRINGS SPECIFIC PLAN TO FACILITATE THE VACATION OF A PORTION OF MUSEUM WAY BETWEEN BELARDO ROAD AND MUSEUM DRIVE IN ORDER TO FACILITATE THE PERMANENT INSTALLATION OF THE “FOREVER MARILYN” STATUE AT THAT LOCATION

RECOMMENDATION:
That the City Council:
Receive, file and accept the Certificate of Sufficiency of Petition Signatures as valid in all respects.
Select one of the following three options:
A) Adopt the following resolution:
RESOLUTION NO. 2023-______, "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA SUBMITTING TO THE QUALIFIED VOTERS OF THE CITY OF PALM SPRINGS AT THE GENERAL MUNICIPAL ELECTION TO BE HELD ON NOVEMBER 5, 2024 AN INITIATIVE MEASURE TO AMEND THE DOWNTOWN PALM SPRINGS SPECIFIC PLAN TO FACILITATE THE VACATION OF A PORTION OF MUSEUM WAY BETWEEN BELARDO ROAD AND MUSEUM DRIVE IN ORDER TO FACILITATE THE PERMANENT INSTALLATION OF THE “FOREVER MARILYN” STATUE AT THAT LOCATION; REQUESTING THE COUNTY OF RIVERSIDE TO CONSOLIDATE SAID ELECTION WITH THE STATEWIDE GENERAL ELECTION OF EVEN DATE; AND SETTING RULES AND DEADLINES FOR ARGUMENTS AND REBUTTALS FOR AND AGAINST THE MEASURE." B) Adopt the following resolution:

ORDINANCE NO. 2023-______, AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS TO AMEND THE DOWNTOWN PALM SPRINGS SPECIFIC PLAN TO FACILITATE THE VACATION OF A PORTION OF MUSEUM WAY BETWEEN BELARDO ROAD AND MUSEUM DRIVE IN ORDER TO FACILITATE THE PERMANENT INSTALLATION OF THE “FOREVER MARILYN” STATUE AT THAT LOCATION, PURSUANT TO CALIFORNIA ELECTIONS CODE SECTION 9215(a).
