Commissioner Stone requested clarification on the second of a motion on the February 14, 2008 minutes Motion #8, seconded by #7, and unanamilou carried, noting the abstention of Vice Chair Bulter.

1. DISCUSSION AND COLOR OF THE SCULPTURE AT THE PALM SPRINGS CHAMBER OF COMMERCE:
The Commissioners discussed and/or commented on the finished texture of the sculpture, the history of the previous approval of sculpture, the lighting of the sculpture and the lighting from the bottom of the piece, discussed the various proposed colors of the piece, maintenance of the sculpture, policy and procedures for the maintenance of loaned art in general,

2. ACQUISTION OF RED ECHO FROM LENNAR, BY ARTIST KONSTANTINE DIMOPOULOS AND DISCUSSION OF THE PLACEMENT AT PALM CANYON AND INDIAN CANYON DIRVE (BANK OF AMERICA MEDIAN):
The Commissioners commented and/or discussed the following with respect to the acquisition: the possible reduction of the cost of the Art, the relationship between Lennar and the Owner of the piece, the background of payments from Lennar to Artist, Lennar deferring their ownership to the piece, the payment to the City and/or purchase of another piece if Lennar does not complete and sells the project, charges on page 6 of the proposal listed as "Developer Charges" and who will pay for these expenses, the cost of the installation of the piece should the City acquire the piece, and the positives of the artwork.

Commissioner Paquin stated her disappointment and embarrassment at the City Council for not acquiring the John Clement Sculpture.
Commissioner Kennedy commented on the City Council evaluation of the
Commissioner Moore commented on the City Council comments with respect to the Commissions action on the and apology and requested clarification from Mayor Pro Tem Foat
Commissioner Stone commented on the City Council decision to not acquire the John Clement Sculpture, and stated his disappointment with the City Council, and commented on the Rainmaker Fountain.
Commissioner Ciali commented on the City Council actions to modify the Public Arts Ordinance and funding of the Palm Springs Art Museum.
Commissioner Kennedy stated his support for funding the Museum, but disagrees with the process to that end.
