CALL TO ORDER:
Chair Klatchko called the meeting to order at 1:36 pm.

Roll Call: 6 members present, 1 members absent, 0 members excused.
REPORT OF POSTING OF AGENDA:
The agenda was available for public access at the City Hall exterior bulletin board (west side of Council Chamber) and the Planning Services counter by 6:00 pm on Thursday, May 5, 2016.
ACCEPTANCE OF THE AGENDA:
Chair Klatchko reported that Item 2B and 2C would be continued; however, public comment will be opened for Item 2B.
The agenda was accepted.
PUBLIC COMMENTS:
Chair Klatchko opened public comments:
JUDY ELMORE, spoke in reference to Item 2B, she expressed concern with the streets, construction vehicles, noise of rock movement. She suggested designating no parking areas for certain areas of the street.
JOHN MC INTOSH, resides near Item 2B, he urged that any development of site should be limited to single-story and elevation be held to a minimum to reduce impact to the neighbors.
ALICE SLEIGHT, spoke in reference to Item 2B, has lived in her home since 1968 and is opposed of the 20% lot width reduction; noting that this is an upscale neighborhood and having two small homes on one lot is a concern.
There being no further speakers public comments was closed.

1A. APPROVAL OF MINUTES: APRIL 27, 2016
Commissioner Weremiuk noted two corrections in the draft minutes.
Motion to approve Approve minutes of April 27, 2016, as amended. Moved by Commissioner Donenfeld, seconded by Commissioner Weremiuk.

2. PUBLIC HEARINGS:
2A. ATEF D. JABER, OWNER OF FIESTA MARKET, FOR A CONDITIONAL USE PERMIT FOR A CONVENIENCE STORE USE AT THE SOSSA'S CENTER, LOCATED AT 3700 EAST VISTA CHINO, SUITE "G", APN 6770-040-027, ZONE M-1-P (CASE 5.0691 CUP). (KL)
Associate Planner Lyon presented the proposed project as outlined in the staff report.
Commissioner Donenfeld requested clarification on imposing landscape improvements to the new conditional use pemit.
Commissioner Weremiuk questioned if a single serving of alcohol (beer or wine mix) is regulated on this type of use.
Deputy City Attorney noted that typically these conditions are imposed by the Alochol Beverage Commission (ABC).
Director Fagg pointed-out that ABC regulates certain types of alcohol licenses within a census tracts.
Chair Klatchko opened the public hearing portion of the meeting:
ATEF JABER, applicant, has lived in the valley for 20 years and has owned grocery stores with liquor licenses through the ABC with no violations.
There being no further appearances the public hearing was closed.
Commissioner Weremiuk commented that she lives adjacent to this site and this vacant site is not a good thing. She said people in the neighborhood would like to see this project succeed. She prefers imposing a condition to restrict selling individual sizes given the fast traffic on Vista Chino.
The applicant responded that some people may not have the money to purchase a full six-pack - given that the AM/PM less than a mile away sells individual sizes.
Commissioner Middleton asked the applicant if small bottles of hard liquor (1 to 2 oz.) similar to airplane flights. The applicant responded said he would sell one pint and largesr and he does not have a problem restricting the small bottles of liquor.
Commissioner Hirschbein noting hesitatancy in restricting the sale of single servings and the vadility of the homeless of a problem that does not exist. It's cumbersome and who will enforce it.
Director Fagg responsed that there is standard language that can be drafted.

Principal Planner Robertson provided a brief overview of the proposed project and noted that additional research is necessary for this application. He requested this item be continued to a date certain.
Chair Klatchko opened the public hearing and with no speakers coming forward the public hearing was closed.

PLANNING COMMISSION REPORTS, REQUESTS AND COMMENTS:
Commissioner Middleton provided details on the Green Building Progam that was developed in 2010 by CVAG noting that the area of concentration on what point should there be requirements that solar panels be installed in new and remodeling construction.
Commissioner Weremiuk spoke about possibilty of meeting with the Parks & Recreation Commissiont.
PLANNING DIRECTOR'S REPORT:
Planning Director Fagg spoke about scheduling a tour of the proposed Eagle Canyon development, a study session schduled on May 25th at 11:30 am is discuss the Rimrock project.
Commissioner Middleton noted she would be out of town on May 25th.
ADJOURNMENT:
There being no further comments the Planning Commission adjourned at 2:23 pm to Wednesday, May 25, 2016, at 1:30 pm preceded by the site tour of the proposed Eagle Canyon development on Monday, May 23, 2016, at 8:00 am.
