Chair Klatchko called the meeting to order at 1:32 pm.

REPORT OF POSTING OF AGENDA:
The agenda was available for public access at the City Hall exterior bulletin board (west side of Council Chamber) and the Planning Services counter by 4:00 pm on Thursday, January 21, 2016.

The following persons spoke in reference to Serena Park - Palm Springs Country Club (prior Study Session item):
DENISE JANSSEN EAGER, expressed concern about traffic safety issues associated with the stop sign at North Farrell / Racquet Club.
TRUDY SMEBY, requested consideration moving the main road (behind the condos) to the wash side.
RENEE SAUNDERS, commented about too much development in one area that will increase traffic congestion.
ALLEN BOWLEY, secretary, Gene Autry Neighborhood Association, said their main concern is the entrance at Verona and Whitewater; noting that the increased traffic will be dangerous. The development is beautiful if they could find a better entrance.
ALLEN WORTHY, spoke about corruption in the city.
CLAIRE RICE, resides in Demuth Park neighborhood, requested a sound and traffic study be conducted to establish that this would not impact them in a negative way.
JIM OSTERBERGER AND MICHAEL MC CARTNEY, representing Spurline Bar, spoke in reference to Item 2A, commented that they met with owner of Chill Bar today and did a sound check and have reached an amicable conclusion.

1A. JENNIFER GUGLIEMO'S APPLICATION FOR A CONDITIONAL USE PERMIT TO OPERATE A KENNEL (DOG DAY CARE, BOARDING AND TRAINING) AND INCIDENTAL RETAIL SALES OF DOG NOVELTY ITEMS WITHIN A 2,345-SQUARE FOOT SPACE OF AN EXISTING BUILDING LOCATED AT 752 VELLA ROAD, ZONE M-1, SECTION 19 (CASE 5.1386-CUP). (ER)
Principal Planner Robertson presented the proposed project to operate a dog kennel as outlined in the staff report.
The Commission questioned and/or commented on:
-Are there any State or Local regulations that need that are required?
-What relationship is the outdoor area to the neighborhood?
-Type of proposed wall?
-Is the City's noise ordinance applicable to this project?
-Will there be more than 11 separate dog kennels?
-Important for dogs to have the oppportunity to enjoy the fresh air and sunshine.
-Dogs should have an outdoor area to enjoy sunshine and air.
-Noise attunation - is there a condition to minimize the barking dogs inside the building?

JENNIFER GUGLIEMO, applicant, indicated that the building has drop ceilings that will mitigate the noise. Ms. Gugliemo noted that she is proposing 50 sq. ft. per space, per dog and they will be separated by size, weight and age. She addressed the outdoor space was available for questions.

Commissioner Donenfeld suggested a condition to required a a six month review

Associate Planner Newell provided an overview of the proposed cocktail lounge as outlined in the staff report.
RON BOWDEN, applicant, Chill Bar, stated they have installed a high-density sound rock wall to mitigate the noise.
Motion to approve To accept and file. Moved by Commissioner Lowe, seconded by Commissioner Weremiuk.
Vote to approve To accept and file. (Approved)
2B. A REPORT ON AN APPROVED LAND USE PERMIT ISSUED TO MIGGY’S CANTINA, LLC FOR OUTDOOR ENTERTAINMENT / MUSICIANS AS AN ACCESSORY USE TO A RESTAURANT LOCATED AT 1555 SOUTH PALM CANYON DRIVE, ZONE PD-131 / I.L. (CASE LUP 13-067). (DN)
Associate Planner Newell provided an overview on the annual update as outlined in the staff memorandum.
Commissioner Weremiuk noted that this business is closed for daily operations but might be open for special events as listed on their website. Ms. Weremiuk recalled noise issues from bass vibrations impacting some neighbors and requested if the facility is in operation would like to get a report back.
Commissioner Middleton requested clarification if the original noise ordinance will remain in effect for special events held in the future. Ms. Middleton questioned if the staff or the Commission has the ability to waive the noise ordinance requirements.
Motion to approve Recieve and file with further review in 3 months. Moved by Commissioner Weremiuk, seconded by Commissioner Lowe.
Vote to approve Recieve and file with further review in 3 months. (Approved)
PLANNING COMMISSION REPORTS, REQUESTS, AND COMMENTS:
The Commission made the following comments:
-Appreciate full-size plans for the Serena Park project and requested large plans for developments of this magnitude.
-Commissioner Weremiuk will be absent on the February 24th meeting.
-Complimented staff on the Serana Park study session; however disappointed with the quality of the presentation from MSA Consulting.
-Independent peer review performed for the environmental documentation.
PLANNING DIRECTOR'S REPORT:
Planning Director Fagg noted that another study session will be held on February 10th to discuss the proposed Serena Park development.
ADJOURNMENT:
