Case 5.1184 CUP / 6.510 VAR (Palm Springs Recycling) - An application by Rick Bracamonte for a Conditional Use Permit to allow a recycling center located at 280 Oasis Road, Zone M-1, Section 34, APN: 669-444-013. (Project Planner: David A. Newell, Associate Planner) (Continued from the July 9th meeting.)
Commissioner Scott left the Council Chamber at 1:45 p.m.
David A. Newell, Associate Planner, provided background information as outlined in the staff report dated July 23, 2008. Mr. Newell reported that code enforcement has received five complaints from separate property owners within the last year mainly due to maintenance issues.
Chairman Hochanadel opened the Public Hearing:
-Peter Bochnewich, legal counsel for the applicant, provided further details pertaining to the complaints received toward the applicant. Mr. Bochnewich requested consideration be given for the property improvements and stringent conditions and requested a 10 year time limit on the conditional use permit.
-Gary Jacobs, Palm Springs, property owner across the street, stated that he is not opposed to the recycling center but would like a stipulation that the applicant is responsible for the upkeep and maintenance of his property.
-Jerry Johnson, Palm Springs, pastor of church next door, concerned with the upkeep and maintenance of the property. Mr. Johnson requested the new height of the wall conceals the stacked materials to prevent debris from blowing onto neighboring properties.
-Frank Burgess, Palm Springs, adjacent neighbor, stated that he is not in opposition to to the recycling center, however, questioned the zoning for this site. Mr. Burgess requested condition #5 changed to "shall" rather than "may"; fire condition #4 pertaining to storage height not to exceed 10 feet; and submittal of plans in less than one year.
-Peter Bochnewich, applicant response, addressed the neighbor’s property maintenance concerns.
There being no further appearances the Public Hearing was closed.
Commissioner Donenfeld noted that he is in favor of a five year time time limit because of the inconsistency of current zoning and the general plan goals for this area.
Discussion occurred on the wall height and a provision to control debris from blowing off site.

-Condition #1C - The height of the wall block wall to be ten feet in height.

-Condition #5 and #8 - To include a performance provision to control debris from blowing off-site.

Chairman Hochanadel opened the Public Hearing:
-Jack Kurchian, Endure Investments, developer, addressed the design and orientation of the site. Mr. Kurchian provided further details pertaining to landscape berming and hours of operation.
There being no further appearances the public hearing was closed.
Discussion occurred on the potential noise to the adjacent residential homes (air tools and the car wash drying cycle) during the evening hours. Staff noted this area is the main delivery access for deliveries to Home Depot.
Motion to To approve, subject to Conditions of Approval, as amended:
-The hours of operaton for the automobile use and car wash facility shall be from7 a.m. to 7 p.m. daily.
-Revise Condition #8 (Final Design): "Final landscaping, irrigation, exterior lighting, and fencing plans shall be submitted for approval by the

Staff responded that the next study session of August 6th would be appropriate for this joint meeting. Chair Hochanadel suggested confirmation of this date with the members of the AAC so that the majority will be in attendance.
PLANNING DIRECTOR’S REPORT:
Mr. Ewing reported that the State has adopted a bill extending one (1) additional year to tentative tract maps and provided further details.
