3. Case 3.2947 MAJ - An application by Lyons Warren Engineers & Architects, agent for Geiger, LLC, to construct a 2,692 square foot "Jack in the Box" restaurant within "The Springs" shopping center located at the northeast corner of Gene Autry Trail and East Ramon Road, Zone PD 291, APN 677-280-032. (Project Planner: Diane Bullock, Associate Planner)
Edward Robertson, Principal Planner, provided background information as outlined in the staff report dated November 22, 2006.
Chair Marantz reported that she was in attendance at the Architecture Advisory Committee meeting and a request was made to have this building resemble the Jack in the Box on Tahquitz Canyon Way and Farrell Drive.
-Steve Schneider, Lyons Warren Architects & Engineers, provided additional information relating to the architecture.
Vice Chair Hochanadel requested clarification on the drive-through and vehicle stacking.
Commissioner Caffery voiced his concerns relating to the cultured stone and landscaping plan at the Jack in the Box on Tahquitz Canyon Way and Farrell Drive.
Commissioner Scott reported that he was in attendance at the Architectural Advisory Committee meeting when the final design was recommended for approval and is in favor of the re-design.

MISCELLANEOUS:
4. Case 5.1056 / PD 314 -TTM 33575 - An application by Palm Canyon 102, LP, (Mesquite Village) seeking approval for the final development plans for a previously approved mixed-use development consisting of 26 live-work units, 80 two-story attached townhomes and approximately 15,000 square feet of commercial space located along the northeast corner of South Palm Canyon Drive and Mesquite Road, Zone PD 314, Section 23. (Project Planner: Edward O. Robertson, Principal Planner)
Chair Marantz stated she has a conflict of interest and would be abstaining on Item 4 and would not participate in the discussion and vote. She left the council chamber at 1:52 p.m.

The Commission discussed phasing, elevations, landscaping along the frontage road and off-site improvements.
-Ted Snyder, applicant, provided additional details pertaining to the phasing, infrastructure improvements and landscaping.
Chair Hochanadel requested the new traffic signal remain inactive until the adjoining driveway is in use.
-Jay Reynolds, architect, gave further details related to the phasing plan.

Chair Marantz stated she has a business related conflict of interest and would be abstaining on Item 5. She would not be participating in the discussion and vote and left the council chamber at 2:22 p.m.

Chair Marantz requested code enforcement follow-up on the brightly illuminated ATM sign located at the Village Pub.
Commissioner Hochanadel reported that the "Now Selling" sign on the construction fence at the site on Ramon Road has been removed.
Craig A. Ewing provided details on a graphic program for construction fencing.
Commissioner Cohen requested follow-up on a sign on the construction fence at the BMW site.
Commissioner Hutcheson requested clarification on city regulations relating to a vacant burnt building on the corner of Vista Chino and North Palm Canyon. He also referred to a letter written on November 10th relating to a speed bump and berm between Racquet Club and Via Escuela.
Commissioner Ringlein requested follow-up on the landscaping for the single family dwellings along the frontage on Racquet Club and Vista Chino. She reported that she will not be in attendance for the December 27, 2006 Planning Commission meeting.
Commissioner Scott requested a historic building at 1000 North Palm Canyon Drive be secured from vandalism. He also stated his concern with the phasing of large projects and requested a study session be held to discuss parking issues at the Convention Center.
Vice Chair Hochandel requested from staff the status of the map for cell tower locations within the city.
Commissioner Cohen reported a stop sign blocked by a tree on the corner of Via Norte and Vista Chino.
Commissioner Caffery commented on an alternative volunteer for the Architectural Advisory Committee.
